New York Marijuana Possession Attorney

The illegal substance known as cannabis (commonly referred to as marijuana) is one of the nation's most widely abused drugs. This drug is an almost all-natural drug and usually consists of flowers, stems, seeds and leaves; the medically noted active ingredient is that of delta-9-tetrahydrocannabinol, commonly shortened to THC. So how does it work? Typically smoked, this drug releases the THC into the body, travelling from the lungs into the blood and then to other areas. Once in the brain, it can begin to mess with the body's perception, the coordination and can also impact a person's ability to remember, learn new material and solve problems.

Have you been charged with a marijuana offense?

In the state of New York, offenses relating to marijuana are taken extremely seriously. That being said, many minor possession charges have been decriminalized and do not carry criminal penalties. If a defendant is charged with the possession of 25 grams or less (regardless of whether it is for a first-time offense or a secondary offense), it will be considered a civil infraction and will carry a monetary fine of $100 and $200 respectively.

This, however, is where the civil infraction ends. Should there be a third offense for possessing the drug in this amount, it will be considered to be a misdemeanor under state laws and will be punished with five days of incarceration and/or a monetary fine of $250. Should the amount be from 25 grams to 2 ounces, it will be considered a misdemeanor and will have a three month sentence for incarceration and a $500 monetary fine tacked onto the end. Should it be over eight ounces, it will be considered a felony and will carry penalties that are proportionally raised in severity.
